Age Discrimination

There are both state and federal laws that prohibits age discrimination in the workplace.

 

The Age Discrimination in Employment Act of 1967 (ADEA) is a federal law that protects certain applicants and employees 40 years of age and older from discrimination on the basis of age in hiring, promotion, discharge, compensation, or terms, conditions or privileges of employment. The ADEA only applies to employers who have 20 or more employees. 

 

Michigan’s Elliott Larsen Civil Rights Act, which protects workers against age discrimination, does not have an age limitation. In other words if you are discriminated against for being "too young" or "too old" you may have a claim under Michigan's law. Unlike the federal law. Michigan's law applies to ALL employers, regardless of the number of people employed by the employer.
