Parenting Time Modifications

Most of us want to spend as much quality time as possible with our children, and often times a court imposed parenting time schedule prevents a parent from spending as much time with their children as they would like. Situations change during the course of a child's life and sometimes a parenting time schedule that worked when a child was in elementary school is no longer workable when the child enters high school.

 

Sometimes a parent's work schedule changes, a child wants to participate in extracurricular activities that interfere with a parenting time schedule, or a parent has to move further away from the other parent which makes the current parenting time schedule unworkable. Sometimes there are other, more negative factors, that would cause a parent to want to restrict or limit the other parent's parenting time, such as drug and alcohol abuse or a parent neglecting the children during his or her parenting time.   

Courts take parenting time modifications very seriously and must first determine if a parenting time modification would change the "established custodial environment." Depending on circumstances of each case, the court will apply the appropriate legal standard when deciding the case. There are a host of factors that the court must take into consideration in these types of cases before the court will even look into whether the change in parenting time is in the best interest of the children.
